1. Acceptance of terms
Welcome to Rise Bright! These Terms of Service ("Terms") govern your use of the Rise Bright platform ("Service"), operated by Rise Bright ("we", "our", "us").
By accessing or using Rise Bright, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

- Only parents/guardians can create accounts for children
- Paid subscription plans are available on monthly, 6-month, and annual billing cadences. Cancellation and refund terms are in section 9.

2. Service description
2.1 What Rise Bright provides
Rise Bright is an adaptive educational platform that provides:
- Personalised learning assessments aligned with the Australian Curriculum
- AI-generated educational content tailored to each child's level
- Progress tracking and parent dashboard
- Support for neurodiverse learners (ADHD, dyslexia, autism, dyscalculia)
- State-specific curriculum alignment (VIC, NSW, QLD, SA, WA, TAS, NT, ACT)
2.2 What Rise Bright is NOT
Important disclaimer
Rise Bright is:
- NOT a diagnostic service - We do not diagnose learning difficulties or medical conditions
- NOT a replacement for school education - We supplement, not replace, formal education
- NOT a tutoring service - We provide self-directed learning tools
- NOT medical advice - Always consult healthcare professionals for medical concerns
2.3 Service availability
We aim to provide continuous service but cannot guarantee uninterrupted access. We may:
- Perform scheduled maintenance (with advance notice when possible)
- Make updates to improve the service
- Experience occasional technical difficulties
3. User accounts
3.1 Account creation
- You must be at least 18 years old to create an account
- You must provide accurate and complete information
- You are responsible for maintaining the security of your account
- One parent account can manage multiple child profiles
3.2 Account security
You agree to:
- Keep your password confidential
- Notify us immediately of any unauthorized access
- Not share your account with others
- Log out from shared devices
3.3 Child profiles
Child profiles can only be created by a parent or legal guardian who:
- Has parental authority for the child
- Consents to the child using the platform
- Accepts responsibility for the child's use of the service
4. Parent/guardian responsibilities
As a parent or guardian using Rise Bright, you agree to:
4.1 Supervision
- Provide appropriate supervision of your child's use of the platform
- Ensure your child understands appropriate online behaviour
- Monitor your child's progress and engagement
4.2 Information accuracy
- Provide accurate information about your child's year level
- Update information if circumstances change
- Only provide learning needs information you're comfortable sharing
4.3 Appropriate use
- Use the platform for its intended educational purpose
- Not attempt to circumvent any security measures
- Not use the platform on behalf of others without their consent
Your rights as a parent
You have the right to:
- Access all data we hold about you and your children
- Request corrections to inaccurate information
- Delete your account and all associated data
- Withdraw consent at any time
5. Acceptable use policy
5.1 Permitted uses
You may use Rise Bright to:
- Access educational content for your children
- Track your children's learning progress
- Export your data for personal records
- Provide feedback to improve the service
5.2 Prohibited uses
You must NOT:
- Use the service for any illegal purpose
- Attempt to gain unauthorized access to our systems
- Interfere with other users' access to the service
- Upload malicious content or code
- Scrape, copy, or redistribute our content without permission
- Use automated tools to access the service (except with permission)
- Create accounts using false information
- Share content that is harmful, offensive, or inappropriate
- Impersonate other users or Rise Bright staff
5.3 Consequences of violation
Violation of these terms may result in:
- Warning notification
- Temporary suspension of access
- Permanent termination of account
- Legal action where appropriate
6. Intellectual property
6.1 Our content
All content on Rise Bright, including but not limited to:
- Educational materials and assessments
- AI-generated lessons and questions
- Website design, logos, and branding
- Software code and algorithms
is owned by Rise Bright or our licensors and is protected by Australian and international copyright laws.
6.2 Your license to use
We grant you a limited, non-exclusive, non-transferable license to:
- Access and use the platform for personal, non-commercial educational purposes
- Download and print materials for your child's personal learning use
6.3 Restrictions
You may NOT:
- Copy, modify, or distribute our content for commercial purposes
- Remove any copyright notices from materials
- Create derivative works based on our content
- Reverse engineer our software or algorithms
6.4 User content
Any content you provide (such as feedback) may be used by us to improve the service. You retain ownership of your personal data as described in our Privacy Policy.
7. Disclaimers
Educational disclaimer
Rise Bright is an educational support tool. It is NOT intended to:
- Replace formal school education
- Provide official academic certification
- Diagnose learning difficulties or disabilities
- Provide medical, psychological, or professional advice
7.1 Service "As Is"
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability or fitness for a particular purpose
- Non-infringement
- Accuracy, completeness, or reliability of content
- Uninterrupted or error-free service
7.2 AI-generated content
Our educational content is generated using AI technology (Claude). While we strive for accuracy:
- AI-generated content may occasionally contain errors
- Content is reviewed but not manually verified for every question
- Parents should use their judgment regarding content suitability
7.3 Third-party services
We use third-party services (such as Anthropic's Claude API) to provide our service. We are not responsible for their availability or performance.
8. Limitation of liability
To the maximum extent permitted by Australian law:
8.1 Exclusion of liability
Rise Bright, its directors, employees, and agents shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, data, use, goodwill, or other intangible losses
- Any damages resulting from your access to or inability to access the service
- Any damages resulting from unauthorized access to your account
8.2 Cap on liability
Our total liability to you for any claims arising from your use of the service shall not exceed the amount you have paid us in the past 12 months (or $100 AUD if the service has been free).
8.3 Consumer guarantees
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law that cannot be excluded, restricted, or modified.
9. Subscriptions, cancellation and refunds
9.1 Subscription plans
Rise Bright offers paid subscription plans on monthly, 6-month, and annual billing cadences. Current pricing is shown when you choose a plan from your parent dashboard. Prices are in Australian dollars (AUD) and include GST where applicable. Payments are processed by Stripe.
9.2 How to cancel
You can cancel your subscription at any time through any of the following:
- Your parent dashboard, by selecting "Manage subscription"
- The Stripe customer portal linked from your account
- Emailing us at support@risebright.com.au
Cancellation takes effect at the end of your current billing period. You will keep full access to the service until that date and will not be charged again.
9.3 Refund eligibility
The refund policy below applies in addition to your rights under Australian Consumer Law (see section 9.6). It is intended to be fair to families on every billing cadence.
9.3.1 14-day cooling off (new subscriptions)
If you cancel within 14 days of your first subscription payment and your child has not made substantial use of the platform (defined as completing more than three full learning sessions), you may request a full refund of that payment.
9.3.2 Annual and 6-month plan partial refunds
If you cancel an annual or 6-month subscription after the cooling off period, you may request a pro-rata refund of the unused portion. We calculate the refund as follows:
- Take the amount you paid.
- Subtract the equivalent monthly rate for each full or partial month already used.
- Subtract the discount you received for choosing a longer plan (10% for 6-month, 20% for annual).
This produces a refund equivalent to what you would have paid had you been on the monthly plan from the start. We do this so families on monthly plans are not disadvantaged by the policy.
9.3.3 Monthly plan refunds
Monthly subscriptions are not normally refundable after the 14-day cooling off period, because you can cancel future billing yourself and avoid further charges. We may issue refunds at our discretion in cases of platform unavailability, service faults, or genuine hardship.
9.4 How to request a refund
Email support@risebright.com.au with:
- Your account email address
- The reason for the refund request
- The Stripe payment reference (visible in your payment confirmation email)
We aim to respond to refund requests within 5 business days. Approved refunds are returned to your original payment method via Stripe and typically appear within 5 to 10 business days, depending on your bank or card issuer.
9.5 Non-refundable circumstances
Refunds are not available where:
- The subscription has been used in breach of these Terms (see section 5, Acceptable use)
- The account has been terminated by us for breach of these Terms (see section 10, Termination)
- The refund request is made more than 12 months after the original payment
9.6 Your rights under Australian Consumer Law
Our refund policy operates alongside, not instead of, your rights under the Australian Consumer Law (ACL). You have statutory consumer guarantees that cannot be excluded. These include guarantees that our service will be:
- Provided with due care and skill
- Reasonably fit for any specified purpose
- Provided within a reasonable time (where no time is set)
If our service fails to meet a consumer guarantee, you may be entitled to a refund, repair, or compensation as set out in the ACL. Nothing in these Terms limits your rights under the ACL.

9.7 Free trials, waitlist, and pilot programmes
From time to time we may offer free access through a beta period, free trial, waitlist invitation, or pilot programme (such as the Remarkable Launcher pilot). During these periods:
- No payment is taken, so no refund is needed if you decide not to continue
- You can leave the waitlist or trial at any time without obligation
- A trial only converts to a paid subscription with your explicit consent at checkout
Plain English summary
Cancel anytime. Full refund within 14 days of your first payment if you have not used the platform substantially. After that, annual and 6-month plans get a fair pro-rata refund. Monthly plans are not normally refunded because you can cancel future billing yourself. Your Australian Consumer Law rights always apply.
10. Termination
10.1 Your right to terminate
You may terminate your account at any time by:
- Contacting us at support@risebright.com.au
- Using the account deletion feature in your dashboard (when available)
10.2 Our right to terminate
We may suspend or terminate your account if you:
- Violate these Terms of Service
- Engage in fraudulent or illegal activity
- Abuse or misuse the platform
- Fail to pay any applicable fees (if introduced in the future)
10.3 Effect of termination
Upon termination:
- Your access to the service will cease
- Your data will be handled according to our Privacy Policy
- You may request a data export before termination
- Certain data may be retained for legal compliance purposes
11. Changes to terms
We may update these Terms from time to time. When we make changes:
- Minor changes: Updated Terms will be posted on this page
- Material changes: We will notify you by email at least 30 days before changes take effect
Your continued use of the service after changes take effect constitutes acceptance of the new Terms.

Changes in 1.1: added section 9 covering subscriptions, cancellation, and refunds; updated key points to reflect paid subscriptions; renumbered sections 10-13.

12. Governing law
12.1 Applicable law
These Terms are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria.
12.2 Dispute resolution
Before taking legal action, you agree to:
- Contact us to attempt to resolve the dispute informally
- Allow 30 days for us to respond and attempt resolution
- Consider mediation as an alternative to litigation
12.3 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
